Our presentation will focus on: 

  • Negotiating and drafting leases and allocating risk between landlords and tenants cognizant of the recent legislative amendments embodied in Ontario’s Construction Act 
  • What landlords, tenants and construction trades need to know in terms of improvements to leasehold interests and the exercise of lien rights in such context 
  • Risk allocation as between landlords and tenants of environmental issues: Phase II environmental assessments, indemnification, business interruption, care and control treatment by the Ministry of the Environment, and liability for orders
